CURP API TERMS OF SERVICE

Please read these Terms of Service (the ”Terms”) very carefully as these Terms govern your (i) access to and/or use of the website located at https://curpapi.mx (the “Website”); (ii) purchase of any services (the “Services”) from Global Data Consortium, Inc. (the “ Company” or “GDC”) offered via the Website or that involve the access and/or use of the CURP API (the “ API”); and ( iii) the possession and/or use of any personal data accessed or provided via the Services. By accessing or using the or the API or by purchasing any Services, you are concluding a legally binding Agreement (the “Agreement”) with GDC to be bound by these Terms. If you are entering into this Agreement on behalf of a company or other legal entity, you also represent that you have the authority to bind such entity to these terms, in which case the terms “you”, “your” or “client” shall refer to such entity. If you do not have such authority, or if you do not agree with these terms, you must not accept this Agreement and may not use the Website, the API or the Services.

Who is Global Data Consortium?

Global Data Consortium, Inc. is a world leader in providing frictionless, electronic identity data verification (eIDV) for individuals and businesses using a broad global network of authoritative third-party identity data sources, to meet customer identification needs and enable trusted customer transactions.

Purpose of the Website

The purposes of the Website are to facilitate the provision of identity verification services by providing developers with easy access to CURP data.

The Services

The Services consist of providing API access to key sources of identity information in Mexico, namely CURP data in order to facilitate identity verification by individuals and/or by entities engaged in identity verification that have the proper authorization to access the CURP data. Using the Services, a User / developer may use the API to validate CURP data via a simple REST endpoint. These Services may be obtained by signing up for the services through our third-party partners RapidAPI and Scorce.

License

The Company grants the User a non-exclusive, revocable, non-sublicensable license to access and use the Website, API and Services in a manner and scope consistent with these Terms and the specific Services purchased. The licenses granted do not include any right to: (a) damage, disable, or impair the Website, API's or Services (b) copy the Website, API's or Services or any part, feature, function or user interface thereof; (c) modify, reroute, create derivative works of, derive the source code of, reverse engineer, disassemble or tamper with Website, API's or Services, or attempt to do any of the foregoing.

Prohibited Uses

You may use the Website, the API and/or the Services only for lawful purposes and in accordance with these Terms. You agree not to use them:

Privacy

Company's Privacy Obligations. Users should carefully read the privacy policy located at (“Privacy Policy) as it is incorporated into this Agreement by reference and governs Company's treatment of any personal information that is gathered by Company or submitted by a User to Company in connection with the use of the Website, the API or the Services. User hereby consents to Company's processing of personal data that User provides in connection with the Services according to the Privacy Policy. In connection with the Website, the API and the Services, the Company represents and warrants that it shall comply with all applicable data protection and data privacy laws.

User's Privacy Obligations. In addition, in connection with the Services and any personal data accessed or received by User via the API or the Services, the User represents and warrants that (i) User shall comply with all applicable data protection and data privacy laws, (ii) User has all legally required consents and authorizations from the relevant rights holders to access and use the personal data available from the CURP, data source, and (iii) User shall only use personal data obtained as permitted by the CURP data source providers as described in the terms of use located at www.gob.mx/terminos.

Security

The Company and User each represent and warrant that in connection with any personal data or confidential information received under this Agreement, they shall maintain appropriate and commercially reasonable organizational, physical, and technical safeguards to protect the security and integrity of any personal data or confidential information that it receives during the term of the Agreement. User acknowledges that User is aware that the security in the use of the Services depends largely on the security of the network through which the User accesses the Services.

Intellectual Property Ownership

The Company is the sole and exclusive owner of all intellectual property rights in and to the Website, the API and the Services, including but not limited to all copyright, trademark, trade secrets and any other legally protectable IP rights. GDC does not claim any ownership to the data obtained via the API.

Disclaimers

The Website, the API and the Services are made available and provided "AS IS". The Company specifically disclaims any and all warranties of any kind with respect to the API and the Services, whether express, implied or statutory, including without limitation warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose. The Company does not guarantee that the API or Services will always remain uninterrupted, on time, safe or free of errors beyond the Company's control. Similarly, the Company cannot be held responsible for failures in the Internet service, interruptions in the power supply service of the servers, or any technical failure that is not directly attributable to the Company's Services. The foregoing exclusions and disclaimers are an essential part of this Agreement. This disclaimer shall be enforced to the extent permitted by law in those jurisdictions that may limit the exclusion of implied warranties.

Limitation Of Liability

Notwithstanding any damages that you might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Services or one hundred ($100.00) U.S. dollars if you have not purchased any of the Services.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Indemnification

You hereby indemnify to the fullest extent Company from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney's fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

General Provisions

Severability. If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver. Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation. These Terms may have been translated from the English original to other languages. You agree that the original English text shall prevail in the case of a dispute.

Modifications or updates to Website, Services or API. The Company may at any time, without notice and without liability, make corrections, additions, improvements or modifications to the Website, Services or API.

Applicable Law, Jurisdiction and Dispute Resolution. Any claim, dispute or controversy of whatever nature (“Claim”) arising out of or relating to this Agreement, the Website, the API or the Services shall be resolved in the state or federal courts located in Raleigh, North Carolina, USA, and User agrees to the exclusive jurisdiction of such courts. This Agreement shall be governed solely by and construed under the laws of the state of North Carolina, USA

Links to Other Website. This Website contain links to third-party web sites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Amendments Or Modifications Of These Terms. The Company may amend, modify or terminate any these Terms at any time and such amendment, modification or termination will be effective at the time Company posts the revised terms on the site. You can determine when this agreement was last revised by referring to the “last updated” legend at the top of this agreement. Your continued use of the site or services after the Company has posted revised terms signifies your acceptance of such revised terms.
